The Special Prosecution Office has not granted Erion Veliaj permission to physically participate in the Municipal Council meeting where the 2026 budget for the capital will be discussed and approved.
Today, the Tirana Municipal Council officially requested the Special Prosecution Office and the General Directorate of Prisons to allow the Mayor of Tirana to physically participate in meetings for the consultation and detailing of the 2026 draft budget for citizens.
According to the request, Veliaj's participation in the consultation and detailing of the draft budget is a process defined as a legal obligation by the legislation on local self-government. In the request, the members of the Municipal Council emphasize that the presence of the mayor is mandatory to guarantee cooperation with the council on issues of public interest.

In relation to this request, it should be taken into account that the legislator, referring to Law No. 81/2020 “On the rights and treatment of prisoners and detainees”, Article 73, points 1 and 2, has determined that “the prisoner has the right to receive special leave in the event of serious illnesses that endanger the lives of family members, confirmed by a medical report, or of important family events, such as death, birth or marriage, as well as in cases of the prisoner taking his own exams. This period is included in the time of serving the sentence. Special leave for the prisoner is granted by the Director of the Institution, while for the detainee it is granted by the Director of the Institution, with the prior consent of the prosecutor”.
Also, based on the Council of Ministers No. 209, dated 06.04.2022 "On the approval of the general prison regulation", articles 101–105, a special regulation is established for cases of special permits, which are exhaustive, referring again to serious illnesses that endanger the lives of family members, confirmed by a medical report, or important family events, such as death, birth or marriage, as well as in cases of taking exams by the convict himself.
Under these conditions, it is concluded that the request made for temporary permission of the detained citizen Erion Veliaj, for physical participation in the Municipal Council meeting of 16–18.12.2025, treated as a request for special permission by the proceeding body, does not meet the criteria set out in the relevant legal framework.
For these reasons, based on article 73, points 1 and 2 of law no. 81/2020, as well as Council of Ministers no. 209, dated 06.04.2022,
WE DECIDED:
Failure to grant prior approval regarding the request for special permission, regarding the physical participation in the Municipal Council meeting on 16–18.12.2025, of the detained citizen Erion Veliaj.
