Milan and Inter have won an important victory in the process for the construction of their new stadium, after the Lombardy Regional Administrative Court (TAR) dismissed the appeal challenging the decision to impose cultural protection on the second ring of the San Siro stadium.
The court's decision follows a lawsuit filed by 82 citizens and three committees against the Municipality of Milan, the Ministry of Culture and the Ministry of Infrastructure, with the aim of annulling a series of public acts related to the project for the new stadium.
Among them were the decisions to announce a public auction for the purchase of the stadium, the agreements with the Politecnico and Bocconi universities, as well as the opinion of the Superintendence on the establishment of cultural protection for the second ring of the stadium, which comes into effect on November 10, 2025.
According to the TAR, insufficient elements have been presented that could give a realistic expectation of success of the appeal. The Court also notes that the plaintiffs have not been clearly identified and that the appeal has been presented inaccurately and without sufficient data to assess its legitimacy.
Regarding the date set for the protection of the second ring, the judges underline that it is based on a technical decision of the relevant administration, which used as a reference the official document of the completion of the works dated November 10, 1955. According to the law, such technical decisions cannot be challenged in substance by the administrative court, except in cases of clear violation of logic or professional criteria, which was not found in this case.
The court also assesses that there is no immediate risk of irreparable damage (periculum in mora), as the plaintiffs claimed, since according to official documentation, the demolition of the current stadium cannot occur before 2030.
This decision paves the way for Milan and Inter to move forward with the new stadium project, although bureaucratic and legal processes are expected to continue in the coming months.
