The Special Court sentenced the three accused of arms trafficking to England to a total of approximately 25 years in prison, while one of the defendants was found not guilty due to lack of evidence.

The Criminal Court of Kosovo has issued a decision on the file of trafficking of weapons and ammunition to the United Kingdom, where the defendants were Adulla Hoxhaj, Admir Tutaj, Rifat Avdiaj and Bojken Turtulli.

After the trial was conducted using the summary trial procedure, the panel consisting of Bib Ndreca, Rudina Palloj and Atalanta Zeqiraj decided to convict the three defendants and acquit one of them.

According to the verdict, Adulla Hoxhaj was found guilty of attempted trafficking in weapons and ammunition, participation in a structured criminal group, and illegal possession of weapons and ammunition. After the sentences were combined and the benefit of a summary trial, he was ultimately sentenced to 8 years and 8 months in prison.

Admir Tutaj and Boyken Turtulli were found guilty of arms trafficking and participation in a structured criminal group. After their sentences were reduced by a third due to the summary trial, both were sentenced to 8 years in prison each.

Meanwhile, Rifat Avdiaj was found not guilty of all charges. The court reasoned that it was not proven that he had committed the criminal offenses he was accused of, so it ordered the lifting of the security measure of "prison arrest" and his immediate release, unless he is being held for some other legal reason.

According to the file, the defendants were accused of: "Attempted trafficking in weapons and ammunition"; "Participation in a structured criminal group"; "Unlicensed possession of weapons and ammunition".

During the operation and checks conducted in 2024, authorities seized a significant arsenal of weapons, ammunition, weapon parts, optical devices, silencers, and other military items.

Specifically, during the search of Adulla Hoxhaj's apartment on August 1, 2024, investigators found:

At least 10 functional pistol firearms;
One Kalashnikov-type semi-automatic weapon;
Dozens of weapon parts, barrels, needles, latches and various mechanisms;
Hundreds of combat cartridges of various calibers;
50 sporting cartridges;
10 optical devices (binoculars) for weapons;
3 laser devices;
2 silencers;
One electroshock device;
Handcuffs, military clothing, helmets and other equipment.

Seized weapons

The court ordered the confiscation of all seized items, while some of the electronic devices and other tools will remain for the purpose of separate proceedings and the property investigation.

As part of the financial investigation, the court ordered that the following continue to remain under verification:

A Volkswagen;
A Toyota RAV4;
An Audi Q5;
A Volvo;
A Honda motorcycle;
Various vehicle documents and navigation permits.

Although the prosecution accused him of being part of a criminal group, the court found that there was insufficient evidence against Rifat Avdiaj to prove the charges of arms trafficking and participation in a structured criminal group, declaring him innocent.

The decision of the Special Court of First Instance for Corruption and Organized Crime shows that, in addition to the convictions for arms trafficking, a large arsenal of weapons, ammunition and equipment seized during the 2024 operation is also evidenced.

The parties have the right to appeal the decision to the Special Court of Appeal within the legal deadline of 15 days from the communication of the reasoned decision.
