
The Tirana Prosecution Office has launched investigations to reveal investigative secrets regarding the video published yesterday, which shows the moment of the murder of 14-year-old Martin Cani, an event that occurred near the Fan Noli school in Tirana, for which a peer, Mario Përlleshaj, is being tried.
The released video shows the moments of the crime that shocked the entire country, where Cani lost his life as a result of stabbings and his classmate was injured.
In an official announcement, the Tirana Prosecutor's Office announced that it has registered criminal proceedings for 'disclosure of secret acts or data'.
The announcement states that "at the conclusion of the investigations, the CD with the film footage available from the prosecution was made available to the defense attorney of the victim's family, the lawyer, who received it and all the acts of the file, in return for signing a statement for its non-publication. This case is currently under trial at the Court of First Instance of General Jurisdiction in Tirana, where the trial on the merits is taking place behind closed doors."

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, registered criminal proceedings for the criminal offense of 'Disclosure of secret acts or data' provided for in Article 295/a after the publication in the media and various portals of a video about the event at the 9-year-old school 'Fan Noli', where the minor MC lost his life.
The video published in several media outlets contains footage from 18.11.2024, showing minors with their generalities labeled next to each other.
As part of the investigative actions carried out in connection with this proceeding, a CD with video footage recorded by security cameras that have a field of view on the road where the minors passed towards the scene of the incident was administered as material evidence, an action which was documented in the report for the examination and collection of material evidence by the judicial police.
The footage, which was published two days ago in the media and distributed on several online portals, contains the same footage that is also on the CD that was administered in the investigative file.
At the conclusion of the investigations, the CD with the footage available from the prosecution was made available to the victim's family's lawyer, who received it and all the documents in the file, in exchange for signing a statement for its non-publication. This case is currently under trial at the Court of First Instance of General Jurisdiction in Tirana, where the trial on the merits is taking place behind closed doors.
It is established that in the specific case, with the publication of the video, both obligations provided for in Article 103/1, 2 of the Code of Criminal Procedure have been violated since evidence (video) that are acts of the closed court hearing have been published, as well as videos, photos and generalities of the defendants, victims and minor witnesses of this case have been published. Given the above, there is sufficient evidence that the elements of the criminal offense “Disclosure of secret acts or data”, provided for in Article 295/ai of the Criminal Code, have been consumed.
