Prime Minister Edi Rama is justifying the failure of the Justice Reform, and this is a bigger mistake than what his government has made with the Reform itself.
His public debates with the associations of judges and prosecutors and any of their spokespeople, or journalists sponsored by the Reform NGO, are attempts to escape the responsibility he has as prime minister and as leader of the parliamentary majority since 2013, for what has happened to justice in Albania.
The debates are not only worthless, but also dangerous, as they create the idea that he is attacking some healthy institutions of justice, diverting the problem from its core.
The essence of the problem is that the Justice Reform has failed. In order to fight a disease that you have caused yourself, you must first accept it. Edi Rama acts as if the Justice Reform is in order, but this thing about the salaries that judges and prosecutors are demanding ruins it. In fact, they are the only people in Albania who do not know how much their salary is and I am a little surprised that they pretend to calculate it.
The superpower that the prosecution and the Special Court have received from the failed Justice Reform has not given Albanian citizens justice, but has increased its price. The cases are before our eyes every day: thousands of untried files, justice that comes a decade late, a frightening arrogance of the prosecution that has turned detentions into corruption ATMs and a multiplied price of corruption in the justice system.

And as if the repressive spirit of SPAK were not enough, we are now faced with an ugly model where every district prosecutor feels like a SPAK prosecutor and imitates the same spirit of repression.
Look at the waste scandal at the Port of Durres by the company "Kurum". In such stories, the criminal has a name. The name of the criminal is the toxic waste production company, which falsifies the composition of the goods and does not declare the waste, as well as its transportation company, which pretends not to know.
Then the pyramid of responsibility goes to the port and customs and of course to the Environment Agency, if they are declared waste. But the moment they are not declared waste, then the crime becomes more serious for “Kurum” and their transporter.
So what happens?
The direct perpetrators of this masquerade are reported and flee to Turkey, while five young men and women from the Environmental Agency, and some customs inspectors whose shift has been cut short, who I believe have no idea what this story is about, are arrested and imprisoned.
Arrestimi i 35 vetëve, nga të cilët shumica nëpunës të vegjël pa asnjë peshë dhe përgjegjësi, është më shumë një skemë korrupsioni sesa një “betejë heroike” kundër korrupsionit. Aty më shumë se korrupsion ka një krim të vetëdijshëm, përgjegjës për të cilin janë ata që prokuroria i ka lënë të ikin dhe pastaj i shpall në kërkim.
Pjesa tjetër është spektakël, që po ta llogarisësh me tarifat qarkulluese shkon mbi 2 milionë euro bakshishe sa të dalin.
E mora këtë si shembull të freskët represioni për të treguar se brenda dy ditësh kemi arrestime djemsh e vajzash të reja nëpunës shteti dhe lirim nga burgu, fjala vjen, të dikujt që akuzohet për tentativë vrasjeje.
Të gjitha këto detaje tregojnë se represioni është thjesht një mjet për të dëshmuar pushtet absolut dhe për të siguruar paprekshmërinë nga parlamenti dhe institucionet e kontrollit mbi drejtësinë, dhe jo drejtësi.
Edi Rama nuk ka nevojë të bëjë polemika me gjyqtarë e prokurorë. Ato mund t’i bëj unë apo ndonjë koleg imi si opinionist nëpër gazeta apo ekrane.
Edi Ramën nuk e kemi votuar si editorialistin më të mirë të vendit, por si kryeministrin më të mirë. Ai duhet t’i dalë zot asaj që ka bërë.
Nëse ka guxim politik dhe nëse ndjen përgjegjësi se Reforma në Drejtësi ka dështuar, duhet ta pranojë atë dhe të marrë të gjitha përgjegjësitë dhe pasojat për ta korrigjuar. Nëse mendon se Reforma në Drejtësi është mirë, se qytetarët po marrin më shumë drejtësi, se vendi po shkon drejt standardeve evropiane të drejtësisë siç patëm ëndërruar kur mbështetëm Reformën në Drejtësi, atëherë të rrijë i qetë, se puna e rrogave nuk është problem. Hallall t’i kenë.
Puna është që shumë prej tyre nuk meritojnë statusin e gjyqtarit dhe prokurorit, pasi po sillen thjesht si një bandë e pavarur gjobvënësish, inatçorësh dhe injorantësh në sistemin e drejtësisë.
Dhe kjo nuk zgjidhet më me polemika dhe debate të kota publike. Le ta fillojë korrigjimin e sistemit me Inspektoriatin e Lartë të Drejtësisë, i cili është institucion brenda sistemit që mund t’u mbrojë qytetarët nga drejtësia e keqe, dhe nëse nuk funksionon, të vazhdojë me ndryshime ligjore që lehtësojnë qytetarët dhe u japin atyre mundësi të marrin drejtësi.
Aq lek sa duan ata për rrogë në një vit, i marrin në një javë si ryshfete me këtë superpushtet dhe mungesë dhënie llogarie që u ka dhënë politika. Një pushtet i pavarur kur është edhe i pakontrolluar, nuk ka arsye të respektojë ligjin. Madje as ta lexojë atë. Ai ka bibël interesat e veta dhe pushtetin e vet të pakufizuar që i keni dhënë.
Ata meritojnë të jenë të pavarur, por jo për të varur çdo njeri që ka punë me drejtësinë.
Kryeministri Edi Rama dhe shumica në pushtet janë përgjegjëse për dështimin e Reformës në Drejtësi, e cila praktikisht është thjesht një operacion special propagandistik që justifikon rrogën e ambasadorëve perëndimorë në Shqipëri, por jo nevojën e qytetarëve shqiptarë për drejtësi.
Many say that the price of escaping this justice reform is conflict with the European Union. I am not sure about this, but if this justice system continues with this irresponsibility, with this high level of corruption, with this pretext of preliminary arrests to extort money, then there is no need to break with the EU, because the image of Albania will be so tarnished as a country where all the people are going to prison, that they will not even accept us in the African Union.
The damage being done to citizens by the failure of the Justice Reform and the damage being done to Albania by this spectacle of arrests is so great and so far from the standards of European justice, that this reform distances us from the EU more than its correction. In both cases, we will remain outside it, with this state of justice. But at least we will remain outside with better justice.
