The Albanian Ambassador to Germany, Aida Sakiqi, has been indicted by the Prosecutor's Office for the criminal offenses of: Abuse of office, falsification of official documents, appropriation of state title and employment of a Russian citizen in the embassy staff.
According to Law No. 23, dated March 19, 2025 "On Foreign Service", Ambassador Aida Sakiqi, already prosecuted, should have been suspended from duty on the day the Prosecution took her into custody.
Article 43 of the law states: - The head and staff of the diplomatic mission and consular post are suspended from duty when they are criminally prosecuted, until a final decision is made.
Criminal proceedings have been initiated against Ambassador Aida Sakiqi and she has been named a defendant, but she has not been suspended from duty, continuing to head the Albanian diplomatic mission in Germany.
She is considered innocent until justice is decided, but according to the law she should be suspended from duty and removed from the diplomatic service; while she was found innocent, she was reinstated.
In the new law "On Foreign Service", this legal definition has been changed, providing for the suspension from duty of an ambassador, consul, or employee only when criminal proceedings are initiated against them by the state to which they are attached.
We do not know if this legal change was made to keep Aida Sakic in the diplomatic service and to protect Albanian diplomats involved in corruption and links to crime.
But the change in the law was made after the criminal prosecution of Ambassador Aida Sakiqi, and has no retroactive effect; forcing Foreign Minister Elisa Spiropali to suspend her from office.
