The new law makes ministry directors "sacrificed" for the minister and his assets...
For every concession affair, Prime Minister Edi Rama has always come to the defense of his ministers, exerting pressure on the media and the judiciary, as happened with Lefter Koka, Ilir Beqje and Olta Xhaçka. When they ended up being defendants and arrested, Rama declared that the government and the Socialist Party are not defense lawyers for those who “eat pears behind their backs”. But reality shows the opposite: every concession has his signature, initiative and guidance.
After the "pears" excuse no longer covered the situation and SPAK's drawers were filled with files for ministers and general secretaries, the prime minister has found a "legal solution". He has drafted a bill that formally transfers the authority to sign financial acts, orders and decisions from ministers to the central directors of ministries, making them legal "sacrifices" for every scandal.
The project was presented as an initiative of the Minister of State for Public Administration and Anti-Corruption, Adea Pirdeni, as part of the reform “according to EU standards”. In fact, the chapters of the negotiations with the EU do not talk about the delegation of signing powers, but only about the fight against corruption, which begins with the prime minister and his ministers.
So, the law does not cleanse the administration of corruption, but protects ministers and secretaries general, saving them from criminal liability, while directors are forced to sign acts that belong to ministers. This legal regulation will make SPAK, for every affair that is discovered, go up to the directors, while ministers, the real leaders of the bargains, remain outside responsibility.
In recent years, ministers have often distributed powers by “delegation” to subordinates, but the new law formalizes this shift of responsibility. Ministry directors have understood Babloku’s scheme: they will be legal victims for the actions of ministers, risking facing SPAK.
