The Governor and Deputy Governors of the Bank of Albania will enjoy special procedural immunity from coercive measures, if the new draft law on the functioning of the central bank is approved. The draft provides that they cannot be subject to arrest, restriction of their freedom, or personal or home searches without prior authorization from the Constitutional Court.
According to the draft law, procedural protection does not apply only in cases where the governor or deputy governors are caught red-handed or prosecuted immediately after committing a criminal offense. In any other situation, the prosecution must first apply to the Constitutional Court to obtain authorization for the arrest or conduct of checks.
The draft stipulates that the request for authorization will be reviewed by the Constitutional Court within two weeks of its submission. If a decision is not made within this period, the request is considered rejected.
The new provisions aim to establish a special procedure for criminal investigations against the top executives of the Bank of Albania, making the prosecution's procedural actions conditional on the prior approval of the Constitutional Court.
The draft law is part of the new legal package for the Bank of Albania, which aims to regulate the organization and functioning of the institution, as well as the legal status of the governor and deputy governors, by defining special procedural guarantees in cases where criminal investigations are conducted against them.
