The Appeal of the GJKKO decided not to change the security measure against Ilir Meta, the President of the PL, arrested in October 2024 by order of the SPAK. In this way, the Appeal of the GJKKO rejected one of the requests of the former President of the Republic that requested the change of the security measure. Meta has made several requests to the GJKKO to change the security measure "prison arrest", which have been rejected by the court, while another request is awaited for a decision by Judge Saida Dollani.
The request reviewed today in the Appeal of the GJKKO was related to a decision by the Supreme Court, which required the reconsideration of the request.
Meta's requests have also been reviewed by the Constitutional Court, which on April 8 rejected by a majority vote the appeal of Ilir Meta, who requested the declaration of the "prison arrest" measure as unconstitutional and objected to the manner of its execution.
Judges Marjana Semini and Marsida Xhaferllari voted to accept Meta's request to overturn the decision on the security measure. While 5 other judges voted against the former President's request. Judge Sonila Bejtja came out with her own opinion, in favor of Meta's request.
The Constitutional Court has found that Meta's complaint was filed in a proper manner and evidences that there is a serious allegation of excessive use of force during the arrest, for which there were also critical remarks by the Ombudsman.
But, according to the Constitutional Court, there are sufficient facts and information to create reasonable suspicion that the former president may have committed the criminal offenses for which he is accused and has been held in custody since October 21, 2024.
