The Court of First Instance of the judicial district of Tirana has refused to recognize and therefore register the Ordinary Assembly that this body held illegally on May 29 of this year.
Shocked by a decision of the highest level of sports justice, the Court of Arbitration for Sport in Lausanne, which described as illegal their election, starting with President Fidel Ylli, the leaders of KOKSH hastily convened an ordinary assembly violating the statutory norms and at the same time the legal provisions of the Albanian state.
However, even though it took place in complete secrecy, the assembly-farce has resulted in a nullity, i.e. without any legal effect, since the Court of First Instance of the General Jurisdiction Tirana, through a decision made on 19.7.2024, judged that " the request of President Fidel Ylli for the registration of the decisions and the General Assembly of May 29, is not based on the law and the statute, so it has been rejected .
But what really happened? KOKSH after a decision of KAS in Lausanne, taken a few weeks ago, canceling the extraordinary assembly of KOKSH in January 2021, where the then President Viron Bezhani was dismissed, calling the subsequent elections of new governing bodies illegal , starting from the current President Fidel Ylli, as well as the Executive Committee, KOKSH instead of respecting the decision of the highest level of sports justice and taking the necessary steps to restore the institution to a legal basis, plunged deeper into the violation and rushed to call the Ordinary Annual Assembly, but in this desperate attempt to organize this farce, he has again violated the Albanian laws and the KOKSH statute itself, writes "SuperSport".
In its decision, the Court of First Instance of Tirana finds that KOKSH has committed a series of violations, starting from the lack of a decision of the Executive Committee of this body to call the Assembly as KOKSH itself has claimed, so it is a question of a fictitious meeting, also non-compliance with the statutory rules for notifying KOKSH members in the form and deadlines set for the conduct of this Assembly, also the Mandates and Ethics Verification Commission has not submitted the necessary practice for recognizing the participants with the right to vote in the Assembly , making it impossible to verify whether the necessary quorum existed for its development and the voting of the decisions that KOKSH claimed to register.
Among other things, KOKSH has scandalously tried to register with the decisions of this farcical Assembly, also the election of 19 arbitrators of the Council of Sports Arbitration, as a body that is created under this institution, but while there is still legally no Council of Sports Arbitration , to have acquired the status of a legal entity as long as there is no decision on its establishment registered in the Court, that is, another failed attempt to manipulate the law, which this time has not escaped justice.
In this way, all the decisions of the farcical assembly of KOKSH have been refused to be recognized by the Court, while this institution, entirely on illegal tracks, is showing that it is ready to commit any violation and manipulation, with the sole purpose of escaping from inevitably, his leaders, now illegal by a decision of the Court of Arbitration for Sport in Lausanne.
