An unusual case in the Spanish judicial system has opened a wide debate on the limits of the use of artificial intelligence in the work of judges , after a magistrate was punished with a disciplinary measure for using ChatGPT while drafting a judicial decision.
According to the decision taken by the General Council of the Judiciary , the judge was fined 1 thousand euros for a serious violation, while the measure of suspension from office was avoided.
The decision was approved by a majority vote by the disciplinary committee , which considered the case problematic in terms of maintaining professional standards and managing judicial information.
The investigation began after linguistic and structural elements were found in the text of the decision that raised suspicions of the use of an artificial intelligence system. It was later confirmed that ChatGPT had been used as an assistant during the preparation of the document, but without sufficient professional control over the final content.
The prosecution had initially requested a harsher measure, including temporary suspension and additional financial sanctions, considering the action a serious violation of judicial integrity. However, this line was not accepted by the disciplinary bodies, which assessed that it was not a question of full delegation of decision-making to the system, but of uncontrolled auxiliary use.
The case has sparked new discussions in Europe about the role of artificial intelligence in the justice system, raising important questions: to what extent can tools like ChatGPT be used in drafting decisions, and who is responsible when they affect official documents?
Legal experts warn that such cases could become increasingly frequent as technology becomes integrated into legal work, making a clearer regulatory framework necessary.
