Behgjet Pacolli, the businessman who took over the construction of the Vlora airport, after being declared the winner of the concession, has set a one-week deadline for Prime Minister Edi Rama to resolve the situation created at the construction site, where representatives of his company Mabco are not allowed to enter what they consider to be their property.
In a public announcement by the Mabco company, it is stated that this situation must be resolved by May 28, otherwise the parties will be seen in Arbitration. Businessman Pacolli's ultimatum to the Albanian state comes a few days after representatives and workers contracted by Mabco were not allowed to enter the construction site.
In the letter, MABCO emphasizes that it acts as the owner of 98% of the shares of Vlora International Airport – VIA sh.pk, as the main investor, financier and guarantor of the project, and not as a regular contractor.
Mabco claims that 2A Group, a partner with 2% of the quotas, is attempting to take de facto control of the project through a contested administration of VIA, registered with the Central Bank, although according to MABCO there is no quota transfer submitted for registration with the Central Bank or approved by the Ministry of Economy and Finance.
"MABCO requests the Albanian state to guarantee immediate and protected access to the construction site for MABCO and its staff by May 28, 2026, to stop using the police to exclude the main investor, to ensure freedom of movement and basic conditions for employees and specialists, to preserve evidence, to unblock critical equipment at customs, to not recognize the effects of the contested notifications of May 14 and 21, 2026, and to organize an urgent institutional meeting with the Ministry of Interior, the Public Works Department, the Civil Aviation Authority, Albcontrol, the Independent Engineer and BKT.
"In the absence of compliance with these requirements by May 28, 2026, MABCO warns of the initiation of international arbitration against the Republic of Albania under the Switzerland-Albania Bilateral Investment Treaty and the pursuit of all legal remedies provided for in the Concession Agreement and in law," the public statement states.

Pacolli and Rama have had an almost friendly relationship, while the Prime Minister did not spare praise for the businessman, who has held important political positions in Kosovo, but has also financially assisted Albania in the deadly earthquake of November 26, 2019.

MABCO i kërkon shtetit shqiptar ndërhyrje urgjente për Aeroportin e Vlorës: afati i fundit 28 maj 2026, përpara arbitrazhit ndërkombëtar
MABCO Constructions SA i ka dërguar një letër zyrtare Ministrisë së Infrastrukturës dhe Energjisë, Avokaturës së Shtetit, Zyrës së Kryeministrit dhe institucioneve të tjera përgjegjëse, duke njoftuar se situata në projektin e Aeroportit Ndërkombëtar të Vlorës ka kaluar nga paralajmërimet e përsëritura në përjashtim faktik të MABCO-s nga kantieri dhe nga kontrolli real i investimit të saj.
Në letër, MABCO thekson se vepron si zotëruese e 98% të kuotave të Vlora International Airport – VIA sh.p.k., si investitori kryesor, financuesi dhe garantuesi i projektit, dhe jo si kontraktor i zakonshëm. Kompania pretendon se 2A Group, ortak me 2% të kuotave, po tenton të marrë kontrollin faktik të projektit përmes një administrimi të kontestuar të VIA-s, të regjistruar në QKB, megjithëse sipas MABCO-s nuk ekziston asnjë transferim kuotash i paraqitur për regjistrim në QKB apo i miratuar nga MIE.
MABCO referon se më 14 maj 2026 administrimi i kontestuar i VIA-s lëshoi një njoftim për ndërprerjen e marrëdhënieve të ndërtimit, të cilin MABCO e refuzoi më 16 maj 2026. Më 17 maj u komunikua kufizimi i aksesit në kantier, ndërsa më 18 maj përfaqësuesve, inxhinierëve, specialistëve, punonjësve dhe nënkontraktorëve të MABCO-s iu ndalua fizikisht hyrja në kantier. Më 21 maj, sipas kompanisë, u lëshua një tjetër njoftim që synon ta paraqesë përjashtimin e MABCO-s si “refuzim për bashkëpunim” dhe të krijojë bazë për inventarizim ose marrje të njëanshme të punimeve, pajisjeve, dokumentacionit dhe materialeve teknike të MABCO-s.
Sipas MABCO-s, ky përjashtim nuk mbështetet në asnjë vendim gjyqësor të formës së prerë, në asnjë vendim të ligjshëm të Autoritetit Kontraktues dhe në asnjë akt të vlefshëm që do të justifikonte largimin e investitorit kryesor nga një projekt strategjik. Kompania pretendon gjithashtu se Policia e Shtetit është përdorur për zbatimin praktik të një vendimi privat të kontestuar, duke krijuar një situatë faktike në favor të 2A Group.
Në letër ngrihen edhe shqetësime për sigurinë dhe lirinë e lëvizjes së specialistëve ndërkombëtarë në zonën e akomodimit të kantierit, përfshirë specialistë kinezë, si dhe për bllokimin për më shumë se shtatë muaj të pajisjeve kritike për certifikimin, përfshirë automjete zjarrfikëse dhe pajisje X-Ray. MABCO kërkon që, përpara çdo hapi drejt certifikimit të aeroportit, të kryhet një auditim teknik i pavarur ndërkombëtar i pistës dhe sistemeve të fushës ajrore, përfshirë AGL, ALS, PAPI dhe sistemet përkatëse të sigurisë aeroportuale.
MABCO njofton se, që prej shtatorit 2025, ka dërguar mbi 50 letra dhe njoftime formale institucioneve shqiptare, pa marrë përgjigje substanciale. Sipas kompanisë, veprimet dhe mosveprimet e institucioneve përbëjnë shkelje të Marrëveshjes së Koncesionit, përfshirë nenet 11.5, 11.9, 13 dhe 18, si dhe të Traktatit Dypalësh të Investimeve Zvicër–Shqipëri.
In economic terms, MABCO states that the project is supported by over €90 million in capital, €6 million in interest paid on the financing, €10 million in direct contributions from MABCO, €152 million in collateral exposure and a first-demand financial guarantee of €72 million. The company estimates that the economic value at risk is in the range of €250–300 million.
