The Durrës Court has released Luis Xhumari, the owner of the jet skis, from prison after the tragedy in which a 34-year-old British tourist, Silvester Oleug, lost his life.
According to the decision announced today, Xhumari has been placed under house arrest, which will be executed in his apartment in neighborhood no. 13, Shkëmbi i Kavajës, Durrës. He was under investigation for the criminal offense of "Violation of safety regulations at work", following the accident that occurred two days ago, where a tourist lost his life after falling from a rented water scooter.
The court deemed the arrest in flagrante delicto legal and ordered the Durrës Prosecutor's Office to execute the house arrest decision.
The incident occurred on June 2 in the Kavaja Rock area, where a 34-year-old British tourist, Silvester Oleug, drowned in the sea after falling from a jet ski he had rented from Luis Xhumari.
Xhumari was arrested in flagrante delicto by the Durrës Police and the Prosecution immediately launched investigations for violations of occupational safety regulations.
"The legal validation of the arrest in flagrante delicto of the person under investigation L. Xh., suspected of committing the criminal offenses "Violation of safety rules at work" provided for by article 289/2 of the Criminal Code.
2. The assignment of the personal security measure "House arrest", provided for by article 237 of the Criminal Procedure Code, against the person under investigation L. Xh., a measure which will be executed in his apartment located in neighborhood No. 13, at Shkëmbi Kavajës, building No. x, floor ix, Durrës.
3. The Prosecutor's Office at the Court of First Instance of General Jurisdiction of Durrës is ordered to execute this decision.
4. An appeal may be filed against this decision at the Court of Appeal of General Jurisdiction of Tirana, within 5 (five) days, starting this deadline from the day after the notification of the reasoned decision.
