SPAK reveals details on the investigations into "Bankers Petroleum"
The investigations into “Bankers Petroleum” seem to have extended to the state levels. SPAK recently received the file from the Fier Prosecutor’s Office, which arrested the Chinese leader and the former director (now released). But for the special prosecutors, the violations go all the way to the highest levels.
A few days ago, it was announced that SPAK had seized the file on the forgiveness of the 120 million euro fine from the Ministry of Finance. But it seems that the investigations also extend to Taxes and other sectors that were responsible for the affairs that took place at Bankers.
SPAK has today published the register of requests and responses for the month of October, where it has also provided answers on the criminal offenses on which the "Bankers" affair is being investigated. According to the document, criminal proceedings have been registered for a total of 8 criminal offenses:
1- “Creating fraudulent schemes related to value added tax”;
2- “Hiding income”;
3- “Laundering of the proceeds of crime or criminal activity”;
4- “Abuse of office”;
5- “Failure to perform duties by tax authorities”;
6-“Passive corruption of high-ranking state officials or local elected officials”;
7- “Structured criminal group”;
8- "Committing criminal offenses by a criminal organization and a structured criminal group", provided for by articles 144/a, 180/3, 181/a, 287, 28, 260, 248, 333/a and 334 of the Criminal Code".
So there are 3 new offenses, after the Fier Prosecution Office had registered proceedings for: "Creating fraudulent schemes related to value added tax", "Hiding income", "Laundering the proceeds of a criminal offense or criminal activity", "Abuse of office" and "Failure to perform duties by tax authorities".
The offense "Passive corruption of high-ranking state officials or local elected officials" stands out. So it means that SPAK is investigating officials who have been involved in affairs with the Chinese. We also have an investigation into a structured criminal group.
On July 3, the Fier Prosecutor's Office raided the offices of Bankers. By decision of the Fier Court, 14 security measures were issued.
The investigation that led to this operation was conducted over a 6-month period, following referral of materials by the Tax Investigation Directorate. According to the Fier Prosecutor's Office, the investigation was conducted using proactive methods and in close cooperation with tax and police structures.
According to the Fier Prosecutor's Office, "Bankers Petroleum" is suspected of having fictitiously increased its expenses throughout its 20-year period of activity, in order to result in losses in its annual balance sheets. This scheme has enabled the company to avoid paying corporate income tax, while benefiting from unjustified VAT refunds, causing millions of lek in damage to the state budget.
The fraud was carried out, according to investigations, with the help of individuals and contracting companies, through forged documents and suspicious financial transactions, carried out with various operators and individuals inside and outside Albania.
