The Special Committee on Good Governance, headed by Fatmir Xhafaj, reviewed the work of the High Prosecutorial Council. The chairman of the committee assessed that, despite some improvements, the High Prosecutorial Council remains one of the most problematic institutions of the justice system.
" In my assessment, there are some positive steps in the work of the KLP, but it remains one of the weakest justice systems in Albania. Many issues related to the prosecution system arise from questionable decision-making by the KLP. Compared to other years, there is improvement, but compared to the powers granted by the law and the expectations of the European Union, there is still much to do," Xhafaj declared.
One of the main clashes was related to the lack of prosecutors. The head of the KLP, Mirela Bogdani, admitted that the system faces high vacancies, but this did not convince Xhafaj.
He criticized the fact that the KLP has requested only 12 new prosecutors from the Magistrates' School, while the system has over 100 empty positions.
" Have you been incapable of making these calculations or is there irresponsibility? With over 100 vacancies, you are only asking for 12 prosecutors. You are not asking for an increase in the total number of prosecutors nor an increase in quotas in the School of Magistrates. How will this situation be resolved? ", he asked Bogdani.
The KLP chairwoman argued that the institution has chosen to maintain the quality standard. "The reason that was put forward was the quality of the candidates and not their number," Bogdani said.
Xhafaj also raised accusations about the way the administration of justice institutions functions. According to him, jobs should not be used for family or political favoritism.
"You need staff, but not to make a mess, to take the friends, the husbands, the wives or the children of prosecutors, judges and politicians. Some institutions have turned into places where the family members of the system are employed," he declared.
Bogdani responded that administrative training is organized by ASPA or with the support of international donors. She also proposed that members of collegial institutions be trained before taking up their mandate and during their tenure.
Regarding the appointment of the head of the National Bureau of Investigation, Bogdani said that the process has just entered its phase and requires time to respect international standards.
She also reacted to the public debates within the KLP. Bogdani apologized for the tone used in some cases, arguing that conflicts are common in collegial bodies. According to her, the institution is working on the adoption of an ethical code that aims to regulate communication between members.
" Measures for inter-institutional dialogue, we apologize for the often raised tones of debates, in collegial institutions a kind of conflict naturally arises, let alone approaches.
"We often have strong confrontations regarding the same concept of how to address it. We have taken measures and I believe that if we cannot reach an agreement or an appropriate solution, we will adopt ethical rules ," she said.
