The ruling party in Kosovo, the Vetevendosje Movement (LVV), has filed an appeal with the Constitutional Court against President Vjosa Osmani's decree dissolving the Kosovo Assembly. The news was announced on Monday by the head of the LVV parliamentary group, Arbërie Nagavci.
In a reaction on the social network Facebook, Nagavci announced that in addition to the request for an assessment of the constitutionality of the decree, the party has also asked the Constitutional Court for its temporary suspension until a final decision is made.
According to her, the president does not have discretionary power to interfere in the functioning of the legislative branch. “It is clear that the President of the Republic does not have the right to interfere in the functioning of the Assembly, much less to take actions that lead to its dissolution,” Nagavci wrote.
President Vjosa Osmani decreed the dissolution of the parliament on March 6, a move that could lead the country to early parliamentary elections. However, the elections have not yet been officially announced.
According to a report by Radio Free Europe, Osmani justified the decision by saying that March 5 was the deadline for electing a new president of Kosovo, while her mandate ends on April 4. According to her, the deputies failed to meet the deadlines set by law.
On the other hand, Nagavci argued that the role of the president in this process is activated only in circumstances clearly defined by the Constitution. She added that the exercise of powers that are not clearly defined by the Constitution could harm the constitutional order and the democratic functioning of institutions.
