Prime Minister Edi Rama will convene the Socialist Party parliamentary group today at 09:00, where he will present a package of legal amendments affecting Article 242 of the Criminal Procedure Code.

The initiative, signed by Edi Rama, Taulant Balla and Ulsi Manja, aims to expand the category of officials who cannot be suspended from office by court decision. After the group presentation, the draft law will be submitted to the Assembly.

"The initiative will be presented initially to the Parliamentary Group at its meeting at the beginning of the week, on Monday morning, and will also be transparent to public opinion, as the presentation of the initiative will be made with the presence of the media ," Rama said yesterday.

Currently, Article 242 provides that the measure of suspension from exercising a public office does not apply to persons elected under the electoral law. With the proposed amendments, this category will be expanded to include the President of the Republic, the Prime Minister, members of the Council of Ministers, the Ombudsman, the Chairman of the Supreme State Audit Office and the Governor of the Bank of Albania.

The existing text of the article stipulates that, with the suspension decision, the court temporarily prohibits the defendant from exercising public office in full or in part, excluding persons elected under electoral law. The new version maintains the same formula, but expands the list of exceptions to include high constitutional functions.

The head of government emphasized that the suspension of a minister for a criminal security measure cannot block other functions of the executive branch and that the independence of the judiciary should not interfere with the powers of the legislature and the executive.

"Today it is independent and must remain independent forever, but the independence of the judicial branch ends where the independence of the other two branches begins, the legislative and the executive, which, among other things, have the right and duty to appoint or dismiss ministers, and this right and duty is not shared with the judiciary, does not belong to the judiciary, and cannot be allowed to be taken over by the judiciary,"  the Prime Minister added.

The Socialists are expected to convene the Mandates Council this week regarding the request for her arrest, after the full decision of the Constitutional Court is made public.

Meanwhile, the leader of the Democratic Party, Sali Berisha, said that this move by Prime Minister Edi Rama for legal changes has not been seen or heard anywhere.

According to him, these movements are for personal protection.

"So, what will we see tomorrow? We will see an act that we have never seen before and never heard of. MP Edi Rama presents an amendment to parliament to protect Prime Minister Edi Rama from suspension, from the courts or when they catch him in a crime. He therefore seeks to create a legal shield.

And that February 20 is the day on which the noblest ideals of Albanians, the missionaries of this country, will fill the streets and squares of Tirana to save Albania from the drug regime, crime and theft of Albanians, to save Albania from the narco-dictator, Edi Rama," Berisha said.
