An investor who goes almost unnoticed in Brussels, but who is bringing a particularly problematic investment model to the Western Balkans, risks constituting a significant obstacle to the accession process of the countries of the region to the European Union.
"There is no problem with the United Arab Emirates per se. The problem arises when investments do not respect the laws in force in the host country, especially when Montenegro already has a legal framework that should prevent the effects of capital eroding," says Iliriana Gjoni, an analyst at the Carnegie Europe think tank.
According to Gjoni, this phenomenon could undermine the prospects of European Union enlargement even in countries that are at the forefront of the integration process. She emphasizes that, given that Montenegro is approaching EU membership, European standards should be implemented even before the country enters the Union.
What is "erosive capital"?
It is a form of capital that is negotiated centrally by the state. It has some distinctive features and is usually presented with great fanfare to gain public support. In practice, what happens is a weakening of the rule of law in favor of predatory capital, to enable it to enter certain markets in the country.
Two essential elements are introduced into this process. The first is the concept of the “strategic investor”, which gives an investor special status and exceptional importance for the country. The second is the adoption of a lex specialis, a special law that facilitates direct investments without subjecting them to normal control and review procedures.
So these investments do not go through standard tendering and competition procedures, but benefit from preferential treatment.
Why are Emirates-funded projects cited as significant examples?
The clearest signal of this model appeared when it was combined with the European Union enlargement process, at a time when Montenegro was closing the negotiating chapters on public procurement.
This caused numerous reactions not only in Brussels, but above all in Ulcinj, the municipality where the project was planned to be implemented. Along the 13 kilometers of Velika Plaža beach, the construction of luxury resorts was planned, according to an agreement reached at the central level between the Montenegrin government and the United Arab Emirates, without any consultation with the local authorities, the mayor, non-governmental organizations or the local community.

në një resort luksoz, me premtimin për rreth 12 mijë vende pune, të cilat nuk janë materializuar kurrë.
Jo larg prej aty planifikohet ndërtimi i një porti të ri me fondet e taksapaguesve shqiptarë, i cili në praktikë do të kryejë të njëjtin funksion si porti aktual, duke sjellë pasoja të konsiderueshme mjedisore.
Pse investimet e Emirateve janë bërë kaq të rëndësishme?
Ballkani - dhe jo vetëm bregdeti - mbetet një aset i nënvlerësuar dhe shumë më i lirë krahasuar me mundësi të ngjashme në Kroaci apo Greqi. Kjo e bën rajonin tërheqës për investitorët, jo vetëm për shkak të kostove më të ulëta, por edhe sepse shteti i së drejtës është më i dobët dhe kontrolli mbi projektet është më pak rigoroz.
Për këtë arsye, ka më pak gjasa që investimet t’i nënshtrohen një shqyrtimi të hollësishëm apo që investitorët të detyrohen të provojnë se projektet e tyre përmbushin të gjitha standardet evropiane.

When the same investor operates in Croatia, France or Italy, the level of control is much higher. In some cases, projects are blocked before they start, while in other cases they are significantly reduced because adaptation to European Union legislation proves to be very difficult.
Montenegro needs investments, especially on the path to EU membership, but they must be in line with both Montenegrin and European legislation.
Do these investments jeopardize the EU accession process?
If this regression continues or side roads are created to avoid the implementation of existing laws, the consequences are very serious, because chapters related to the rule of law are closed only at the end of the negotiation process and are monitored at all times.
Once a lex specialis is adopted for a strategic investor, on paper the law is not directly violated. However, if one analyzes the content of these agreements - where the law on public procurement does not apply to economic cooperation agreements in the tourism sector - we are essentially dealing with the legalization of something that would otherwise be illegal.
The European Union has acknowledged that such agreements could harm the accession process and that they will be closely and continuously monitored.
Another crucial chapter is Chapter 27, which deals with the environment and climate change.
If such projects are to be realized, it could become one of the most problematic chapters, as experts have warned that the environmental impact would be considerable. Instead of this issue hindering European integration, the situation could be used as
an opportunity to create a regional training center in the field of environmental governance.
Both sides lack the human resources to face the challenges of the future and this could be a good opportunity to build a bridge of cooperation between the two countries and to develop in practice a cross-border cooperation model similar to that of the European Union. / Pamphlet from "Balcani Caucaso"
