Ervin Mata attempts to be released in Brazil, but is rejected by the court...
The Federal Supreme Court of Brazil has cleared the way for the extradition of Ervin Mata to Tirana. The latter was arrested in Brazil at the end of April, but has followed the judicial process to request his release. However, his requests have been rejected even at the highest level.
The decision is dated July 21, 2026 and was signed by Minister Alexandre de Moraes, rapporteur of extradition case no. 1.925, where the applicant is the Government of the Republic of Albania.
Albanian authorities are requesting the extradition of Ervin Mata for criminal proceedings related to charges of drug trafficking, committing criminal offenses within the framework of a criminal organization and a structured criminal group, as provided for by the Criminal Code of the Republic of Albania.
The decision published by "EuronewsAlbania" also presents the chronology of the procedure. According to the Court, the preventive arrest measure against Mata was ordered on March 11, 2025, while his arrest by the Brazilian Federal Police was executed on April 25, 2026.
Following the arrest, the Federal Supreme Court conducted the procedures for questioning the person sought for extradition. The defense presented its objections, requesting the dismissal of the extradition request or the replacement of the arrest with alternative security measures.
Mata's lawyers claimed that Albania had not respected the legal deadline for formalizing the extradition request. According to them, other issues related to jurisdiction over the alleged criminal offenses should also have been examined.
The Brazilian Supreme Court rejected these arguments. In his reasoning, Minister Alexandre de Moraes emphasizes that the formal extradition request was filed with the Brazilian authorities on March 7, 2025 and was reconfirmed through Note Verbale No. 46/2026 of the Embassy of the Republic of Albania, transmitted on July 2, 2026.
According to the decision, this documentation proves the continued interest of the Albanian state in the extradition of Mata and the fulfillment of the procedural requirements. The court also refers to the position of the Brazilian Attorney General's Office, which had expressed itself in favor of accepting the extradition request and against his release.
The decision argues that preventive arrest in extradition proceedings is an essential measure to guarantee that the requested person remains at the disposal of the authorities and to ensure the implementation of a possible positive extradition decision.
Minister Alexandre de Moraes assesses that in this specific case there are no exceptional circumstances that would justify lifting the arrest measure, also mentioning the risk of the wanted person fleeing.
In conclusion, the Federal Supreme Court of Brazil decided: to reject the request to revoke the preventive arrest of Ervin Mata; not to replace the arrest with other security measures; to reject the defense requests to carry out other investigative actions.
With this decision, Ervin Mata will continue to remain in custody in Brazil, while the Albanian authorities' request for his extradition continues to be reviewed.
Mata has been internationally wanted by SPAK since November 2023. The Federal Supreme Court had issued an arrest warrant for Ervin Mata, who is wanted by SPAK as responsible for trafficking significant quantities of cocaine from Latin America to Europe.
Earlier, the Albanian judiciary filed a request with the Brazilian courts for the extradition of the businessman. According to the Special Prosecution Office, Ervin Mata, together with his group, is responsible for trafficking narcotics from Latin America to Europe.
Also, according to SPAK, a quantity of 931 kg of narcotics was seized from this group over a period of 2 years. The group in question is believed to have invested the money earned from drug activity in Albania in construction. In order not to be noticed by the authorities, they moved the money through the Hawala system. /Pamphlet
