
Adriatik Lapaj does not give up the 'fight' to become an MP
The "Albania Becomes" movement has appealed to the Complaints and Sanctions Commission the decision of the Central Election Commission, which passed the mandate of MP 'Kleana Xhuveli', sister of Adriatik Lapaj.
Lapaj has once again presented all his claims as to why the mandate belongs to the open list, reminding KAS that the candidates on the closed list resigned from their candidacy on May 11.
Likewise, Lapaj tells KAS not to accept the revocation of the resignations of Kleana Xhuveli and Zeqir Kordhoni and therefore pass the mandate to him as the most voted candidate on the open list.
It is now expected that the KAS will review the issue and come up with a final decision, which will finally determine the name of the new MP who will take the mandate.
"The issue raised by the CEC is unrelated to the situation we are in. We are faced with a situation where 12 candidates have expressed their will in writing on May 11 to resign from their candidacy, and if the CEC had fulfilled its legal obligation to issue an administrative act (of approval, rejection or whatever form and content), we would be faced with the fact that the CEC would not have entered into this discussion at all, but would have proceeded with the burning of the closed list and would have proceeded with the transfer of the mandate to the most voted candidate on the open list.
In the conditions where the CEC has not acted in accordance with the law, it has placed the electoral subject in a legal uncertainty in relation to all other electoral subjects, creating a dangerous precedent for the electoral system and institutional power, violating the relationship between the institution and the individual. This is due to the fact that the CEC's silence has created the conditions for the will of the withdrawn candidates to be imposed.
Part of this appeal process should also be the interpretation and unification of the various practices followed by the CEC by applying the precedent case of the 2021 parliamentary elections where candidate Tom Doshi withdrew from the candidacy on election day and the CEC expressed its decision, one day after this act. Did the CEC change the multi-name lists in this case?! Did this fact constitute reason for the CEC to call this action a change of the multi-name lists in violation of Article 73/4 of the Electoral Code?! ", Lapaj's request states.
We recall that the Central Election Commission (CEC) approved on July 23 the summary table of results for the Tirana district, formalizing the final allocation of mandates for the Albanian Parliament.
The head of the CEC, Ilirjan Celibashi, said that the mandate of the 'Shqipëria Bëhet' initiative for Tirana passes to Kleana Xhuveli.
Kleana Xhuveli, fourth on the coalition's closed list, has arrived at the CEC meeting room. Xhuveli is a relative of candidate Adriatik Lapaj, who was declared the winner with the most preferential votes on the open list.
The conclusion is that there can be no resignation from the candidacy, since the lists have been approved. And this is so for any reason. So since Kleana Xhuveli is ranked before Zeqir Kordhoni in the closed coalition list, it is up to her to take the mandate of this coalition.
"Finally, I declare Ms. Kleana Xhuveli the winning candidate," said Celibashi.
